What is the status of the acetaminophen lawsuit in 2022?
Acetaminophen lawsuits were consolidated by the Judicial Panel on Multidistrict Litigation for preliminary proceedings in Southern District of New York courts. The order consolidates 16 claims across seven jurisdictions in the United States.

Current defendants include Walmart, Walgreens, Costco, Rite Aid, Safeway, and CVS. It is expected that certain manufacturers of acetaminophen will be brought into litigation. Defendants opposed consolidation of the claims for multidistrict litigation proceedings. They said that consolidating the cases for pretrial proceedings was premature.
Despite acknowledging that additional defendants may be named in lawsuits in the future, the court ruled there are already sufficient common factors in the claims, including the use of acetaminophen among plaintiffs. Multidistrict consolidation allows litigants to pursue discovery and other pretrial proceedings more efficiently. The court determined that New York was an acceptable forum for consolidation because of the presence of multiple defendants and the ability of litigants to participate in the action in New York courts.
