When you have pain, acetaminophen is the first thing you may reach for, commonly known as Tylenol. For years, we’ve been told it’s safe. Even pregnant women were told Tylenol was safe to take.

But that may not be the case. Researchers have evaluated as many as 16 studies that link acetaminophen use during pregnancy to various neurological and behavioral disorders in children.

Victims whose children have suffered from autism, ADHD, and other functioning disorders are taking legal action to hold manufacturers and retailers accountable. Children may deserve financial compensation because of the neurological harm that they have suffered.

About Acetaminophen and Pregnancy Risks

What is acetaminophen?

Acetaminophen is an over-the-counter pain reliever. It’s commonly used for headaches, aches and pains, cramps, and colds. It may be used to reduce fever. (Medline Plus, Acetaminophen)

Acetaminophen is the primary active ingredient in Tylenol, manufactured by Johnson & Johnson.

What behavioral problems may result from acetaminophen use in pregnancy?

Acetaminophen in pregnancy may be linked to the following:

  • Autism spectrum disorder
  • ADHD
  • Communication delays and difficulties
  • Oppositional defiant disorder
  • Executive function deficits
  • Poor psychomotor development

If your child suffers from any of these challenges, and the mother used acetaminophen during pregnancy, the child may qualify to be a part of this litigation.

Is there a lawsuit against Tylenol?

As of 2022, dozens of Tylenol lawsuits have been filed across the United States. More lawsuits are expected. The defendants are retailers who sold acetaminophen to consumers.

New plaintiffs can currently join Tylenol lawsuits. They have the right to representation from a lawyer of their choice. The Elrod Pope Law Firm is currently accepting Tylenol lawsuit claims. Contact us today to review and start your case.

What is the status of the Tylenol lawsuit in 2022?

Acetaminophen lawsuits were consolidated by the Judicial Panel on Multidistrict Litigation for preliminary proceedings in Southern District of New York courts. The order consolidates 16 claims across seven jurisdictions in the United States.

See In re: Acetaminophen – ASD/ADHD Products Liability Litigation, MDL No. 3043, October 5, 2022.

Current defendants include Walmart, Walgreens, Costco, Rite Aid, Safeway, and CVS. It is expected that Johnson & Johnson, makers of Tylenol, will be brought into litigation. Defendants opposed consolidation of the claims for multidistrict litigation proceedings. They said that consolidating the cases for pretrial proceedings was premature.

Despite acknowledging that additional defendants may be named in lawsuits in the future, the court ruled there are already sufficient common factors in the claims, including the use of acetaminophen among plaintiffs. Multidistrict consolidation allows litigants to pursue discovery and other pretrial proceedings more efficiently. The court determined that New York was an acceptable forum for consolidation because of the presence of multiple defendants and the ability of litigants to participate in the action in New York courts. You do not have to be in New York to bring a claim. Any victim may qualify to bring a case.

What is the basis of the Tylenol pregnancy lawsuits?

The legal basis for the Tylenol pregnancy lawsuits is:

  • Tylenol poses an unreasonable risk of neurological effects in infants when used by pregnant women
  • Manufacturers and retailers knew or should have known about the risks
  • They continued to supply acetaminophen to pregnant women
  • Women consumed acetaminophen while pregnant
  • Some children suffered neurological disorders from their exposure to Tylenol during pregnancy
  • These children have harm and damages

Product liability is the legal basis for the Tylenol pregnancy lawsuits. The claims seek to hold companies liable for making and selling an unreasonably dangerous product.

Who qualifies to file a Tylenol lawsuit?

You may qualify to file a Tylenol lawsuit if you are the parent or guardian of a child suffering from adverse neurological outcomes, including autism or ADHD. The child’s mother must have used Tylenol during pregnancy.

A child who has suffered damages and harm from the mother’s use of Tylenol in pregnancy may bring a lawsuit. Claims may depend on the volume of medical research showing an increasingly strong link between use of the drug and adverse neurological outcomes. They may also rely on family medical history to identify causation between Tylenol use and harm and the likely damages that have resulted to the victim.

How much can you win from a Tylenol lawsuit?

Because of the widespread use among millions of people, it is expected that the total body of litigation addressing Tylenol and its use during pregnancy will be multi-million dollar litigation. It is hard to estimate an exact figure each victim can expect to receive because of numerous substantive and procedural variables that may impact claim amounts.

A victim of a dangerous and defective product may claim compensation for their damages and harm. A child with autism, ADHD, or another neurological disorder may have a lifetime of personal challenges due to acetaminophen use. Their parent may have used the drug without any thought – not knowing the potential risks and causes of harm.

A legal claim may address a child’s medical needs and interventions when they suffer from neurological and behavioral complications. Changes in lifestyle, personal suffering, and caregiving needs may be addressed.
